Acceptance of Terms

By accessing or using our website or mobile application (the “Service”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you may not use the Service.

1. Description of Service

Alrgi LLC (“Company,” “we,” “our,” or “us”) provides a platform that aggregates, standardizes, and presents allergen and dietary information for restaurant menu items. The Service is available in a free tier with core features, and optional premium subscription tiers that unlock additional personalization and allergen features.

The Service is designed to help users make more informed dining decisions by improving access to allergen-related information.

2. Important Health & Safety Disclaimer

  • All information is provided for informational purposes only.
  • Menu items, ingredients, preparation methods, and cross-contamination risks may change at any time.
  • Restaurants may provide incomplete, outdated, or incorrect information.
  • We do not control restaurant operations or food preparation environments.

You must always confirm allergen information directly with the restaurant before ordering or consuming any food.

3. No Warranty of Accuracy

We make reasonable efforts to provide accurate and up-to-date information. However:

  • We do not guarantee the accuracy, completeness, or reliability of any information.
  • Information may be outdated, incomplete, or incorrect.
  • Data may be sourced from third parties, including restaurants.
  • We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

The Service is provided “as is” and “as available” without warranties of any kind.

4. Limitation of Liability

We shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to:

  • Allergic reactions.
  • Illness, injury, or death.
  • Loss of income, revenue, or business.
  • Emotional distress.

This applies to any claims arising from:

  • Reliance on the Service.
  • Inaccurate, incomplete, or outdated information.
  • Restaurant errors, omissions, or practices.
  • Cross-contamination or food preparation risks.

This limitation applies even if we have been advised of the possibility of such damages.

Our total liability, if any, shall not exceed:

  • The amount paid by you to use the Service during the 12 months preceding the claim, if you are a paying user.
  • $0 if you have not paid to use the Service.

5. Assumption of Risk

By using the Service, you acknowledge and agree that:

  • Use of the Service is at your own risk.
  • Dining with food allergies involves inherent risks.
  • You assume full responsibility for all decisions and actions taken based on the Service.
  • You are solely responsible for verifying allergen information directly with restaurants before ordering or consuming any food.
  • Reliance on any information provided through the Service is at your own risk.

6. User Accounts

To access certain features, you may be required to create an account.

You agree to:

  • Provide accurate and complete information.
  • Maintain the security of your account.
  • Notify us of any unauthorized use.

We are not responsible for losses resulting from unauthorized account access.

Account Deletion

You may delete your account at any time directly within the app via Account Details. Upon deletion, your personal data will be permanently removed within 30 days. Anonymized contributions such as restaurant ratings may be retained but cannot be linked back to your identity. Deleting your account does not automatically cancel any active subscription – you must cancel your subscription separately via your Apple ID Settings before deleting your account.

7. Subscriptions and In-App Purchases

The Service offers the following subscription options:

  • Free tier – core features available at no cost
  • Alrgi+ Custom – personalized allergen profiles, custom menus, and allergen insights, available on a monthly or annual basis
  • Alrgi+ Unlimited – full access to all features, available on a monthly or annual basis

Billing and Auto-Renewal

In-App Purchases are facilitated by Apple and managed through RevenueCat. By making a purchase, you agree to Apple’s Terms of Service and RevenueCat’s Terms of Service.

Subscriptions are billed through your Apple ID account. By subscribing, you authorize Apple to charge your payment method on a recurring basis at the applicable subscription price. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Pricing

Current subscription prices are displayed within the app at the time of purchase. Prices are subject to change with reasonable notice. If a free trial or introductory offer is available, it will be clearly disclosed before purchase. Any unused portion of a free trial is forfeited upon subscription purchase.

Cancellation

You may cancel your subscription at any time through your Apple ID Settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the paid period.

All purchases are processed by Apple through the App Store. We do not directly process payments or issue refunds. Refund requests must be submitted to Apple in accordance with Apple’s refund policy.

Restore Purchases

If you have previously purchased a subscription, you may restore your purchase at any time using the Restore Purchases option available within the app.

8. Restaurant Responsibilities

If you use the Service as a restaurant or business:

  • You are solely responsible for the accuracy of all information you provide.
  • You agree to keep your menu and allergen information up to date.
  • You are responsible for your food preparation practices and disclosures.

We are not responsible for any inaccuracies in restaurant-provided data, or any information displayed on the Service, whether entered by the restaurant or on their behalf.

9. Acceptable Use

You agree not to:

  • Use the Service for unlawful or harmful purposes.
  • Misrepresent information.
  • Interfere with or disrupt the Service.

We reserve the right to suspend or terminate accounts at our sole discretion, with or without notice, for violations of these Terms or for any other reason.

10. Third-Party Content

The Service may include content provided by third parties, including restaurants.

We do not control and are not responsible for:

  • The accuracy or completeness of third-party content.
  • Any damages resulting from reliance on such content.

The Service integrates with third-party services including Google Firebase and RevenueCat. Your use of the Service is also subject to their respective terms of service and privacy policies.

11. Intellectual Property

All content, features, and functionality of the Service are owned by Alrgi LLC and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works without our permission.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Termination of your account does not entitle you to a refund of any subscription fees paid. Any active subscription must be cancelled separately through your Apple ID Settings.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without liability.

14. Changes to Terms

We may update these Terms from time to time.

Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Privacy

Please review it to understand how we collect and use your information.

16. Indemnification

You agree to indemnify, defend, and hold harmless Alrgi LLC from and against any claims, liabilities, damages, losses, or expenses arising out of:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your reliance on allergen or menu information.
  • Any harm resulting from your dining decisions.

This obligation applies to any claim brought by a third party arising from your use of the Service or violation of these Terms.

17. Governing Law, Venue, and Arbitration

These Terms shall be governed by and construed in accordance with the laws of the State of Kentucky, United States, without regard to conflict of law principles.

Arbitration Agreement:
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered in Jefferson County, Kentucky, in accordance with the rules of the American Arbitration Association.

  • The arbitrator’s decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
  • You and the Company agree to waive the right to a trial by jury and to waive the right to participate in a class-action or representative proceeding.
  • This arbitration agreement does not prevent you from seeking injunctive or other equitable relief in a court of competent jurisdiction if necessary to protect your rights.

By using the Service, you acknowledge and agree that you are waiving the right to resolve disputes in court (except as noted above) and will submit any claim to arbitration.
